If you have been working full-time for a multi-national company in a skilled, managerial or executive role for at least one year, continuously in the last three years, anywhere in the world, and your company is willing to transfer you to a Canadian office in the same role, you may obtain extra CRS points, once you have worked in Canada for a year on a valid work permit.

Intra-Company Transfer Startup (“ICT Start-Up”)

As you have been working full-time for a multi-national company in a skilled, managerial or executive role for at least one year, continuously in the last three years, anywhere in the world, and your company is willing to transfer you to a Canadian office in the same role, you may be eligible for the ICT Start-Up, which is a temporary work permit, initially for one year.

In order to establish your eligibility for this program, we would need to have a breakdown of the number of shareholders in the parent company in XXXX, and the percentages that each shareholder has.

In addition, we would need to ensure the following:

Requirements for the company

  • Generally, the company must secure physical premises to house the Canadian operation, particularly in the case of specialized knowledge. However, in specific cases involving senior managers or executives, it would be acceptable that the address of the new start-up not yet be secured; for example, the company may use its counsel’s address until the executive can purchase or lease a premise;
  • The company must furnish realistic plans to staff the new operation, with a very detailed business plan that outlines the following:
    • Corporate structure between the entity in XXXX and the anticipated entity in Canada;
    • Financials of the company in XXXX. The company must have the financial ability to commence business in Canada and compensate employees. This means showing the financials for the head office in XXXX, to show that it can financially support the Canadian office;
    • Potential clients in Canada;
    • Projected sales and revenue;
    • Number of Canadians that the company intends to hire in the first year;
    • Please note that there may be more information and/or documentation required at a later date.

 

If you own less than 49% of the company in XXXX, once you have worked in Canada for a year on a valid work permit, and you have improved your English, we may be able to apply for Express Entry (see below).

Significant Benefit

If your company is already established in Canada, we could look at a Significant Benefit application.  Please note that this is a discretionary application, and subject to a Canadian Visa Officer’s view of the company.

Other Factors

Some factors that a Canadian Visa Officer will look at are as follows:

  • Your official academic record showing that you have a degree, diploma, certificate, or similar award from a college, university, school, or other institution of learning relating to the area of their ability;
  • Evidence from current or former employers showing that you have significant full time experience in the occupation is sought (significant in this context can be taken to mean ten or more years of experience);
  • Whether been the recipient of national or international awards or patent;
  • Evidence of membership in organizations requiring excellence of its members;
  • Whether you have ever been required to judge of the work of others;
  • Evidence of recognition for achievements and significant contributions to the field by peers, governmental organizations, or professional or business associations;
  • Evidence of scientific or scholarly contributions to the field by the foreign national;
  • Publications authored by the foreign national in academic or industry publications;
  • Leading role of the foreign national in an organization with a distinguished reputation;
  • How many Canadians (Canadian citizens or permanent residents) will be hired;
  • What the Canadian revenue forecast will be in three months, six months and one year; and
  • The contracts/clients that you will target/have obtained.

Because this is discretionary work permit, there may be additional requirements.
